What constitutes transportation of a controlled substance in Nevada?

NRS 453.321 classifies transportation of a controlled substance as:

  • Drugs classified as Schedule I, and are under 4 grams; or
  • Drugs classified as Schedule II, and are under 28 grams.

Common Schedule I drugs include any of the following:

  • LSD
  • Ecstasy
  • Marijuana
  • Methaqualon
  • PCP
  • Mescaline

Common Schedule II drugs include any of the following:

  • Methamphetamine (Crack, Crystal Meth, Speed)
  • Cocaine
  • Codeine
  • Morphine
  • Opium
  • Barbiturates
  • Adderall

What are the penalties of transporting controlled substances in Las Vegas?

If the Schedule I or II drugs are under 4 grams, you are guilty of a category B felony and will be punished:

  • First time offense:
    • A minimum of 1 year and a maximum of 6 years in a state prison; and
    • A possible fine of no more than $20,000
  • Second time offense:
    • A minimum of 2 years and a maximum of 10 years in a state prison; and
    • A possible fine of no more than $20,000
  • Third time offense or subsequent offense:
    • A minimum of 3 years and a maximum of 15 years in a state prison; and
    • A possible fine of no more than $20,000

Defenses to transportation of a controlled substance:

  • Illegal search and seizure. If the drugs were obtained illegally, either without probable cause or without a search warrant, the evidence should excluded.
  • The drugs were not in your possession. If you did not know that the drugs were there and belong to someone else, you should not be charged with transportation of a controlled substance.
